Terms of Service

Welcome to 123 ToDo. These Terms of Service ("Terms") govern your access to and use of the 123 ToDo website and application (the "Service"), operated by Unforgettable Management Ltd. By using 123 ToDo, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Nature of the Service

123 ToDo is a privacy-first productivity tool. All task data you enter into 123 ToDo is stored locally in your browser using technologies like LocalStorage and IndexedDB. We do not store your tasks on our servers.

123 ToDo also offers an optional Google Drive Sync feature. When enabled, your task data is encrypted on your device using AES-256 zero-knowledge encryption before being uploaded to your personal Google Drive account. We never have access to your data or your encryption passphrase at any time. This sync feature is entirely opt-in and can be revoked at any time.

Shadow Backups provide an additional layer of automatic local redundancy within your browser.

2. Description of Service

123 ToDo is a free, browser-based task management application. The core Service operates entirely within your web browser using local storage. An optional Google Drive Sync feature allows you to back up and sync your encrypted data across devices using your own Google account. No unencrypted data is ever transmitted to or stored on our servers.

3. No Account Required

123 ToDo does not require user registration or account creation to use the core Service. You can use it immediately without providing any personal information. The optional Google Drive Sync feature requires you to authenticate via your existing Google account using OAuth 2.0. We do not store your Google credentials.

4. Data Storage and Responsibility

Your task data is stored and managed as follows:

• Local Storage (default): Data remains on your device in your browser's localStorage and IndexedDB only
• Shadow Backups: An automatic secondary copy is maintained locally within your browser for redundancy
• Google Drive Sync (optional): If you enable this feature, your data is encrypted on your device with a passphrase you control, then stored in your personal Google Drive. We have no access to this data or your passphrase
• Clearing browser data, uninstalling the browser, or device issues may result in loss of your local data
• If Google Drive Sync is not enabled, we cannot recover lost data under any circumstances
• If Google Drive Sync is enabled, data can be restored from your Google Drive on any device using your passphrase
• You may also export your data manually at any time as an additional precaution

5. Google Drive Sync — Specific Terms

When using the optional Google Drive Sync feature:

• You must have a valid Google account and grant 123 ToDo the specific OAuth permissions requested
• Your data is encrypted on your device using AES-256 encryption before it is uploaded — we never see unencrypted data
• Your encryption passphrase is never transmitted to us or stored on any server we control
• Data is stored in a dedicated folder within your personal Google Drive, governed by Google's own Terms of Service and Privacy Policy
• You may revoke 123 ToDo's access to your Google Drive at any time via your Google Account settings
• We are not responsible for Google Drive outages, changes to Google's APIs, or changes to Google's terms
• If you lose or forget your encryption passphrase, your synced data cannot be recovered by us or anyone else

6. User Responsibilities

You agree to:

• Use the Service in compliance with all applicable laws and regulations
• Not attempt to reverse engineer, decompile, or access the source code of the Service for malicious purposes
• Not use the Service for any illegal or unauthorized purpose
• Keep your Google Drive Sync encryption passphrase safe — losing it means losing access to your synced data
• Not hold us liable for any data loss, regardless of cause

7. No Warranty

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. We make no warranties or representations about the accuracy, reliability, completeness, or timeliness of the Service.

We do not warrant that:

• The Service will meet your requirements
• The Service will be uninterrupted, timely, secure, or error-free
• Results obtained from the Service will be accurate or reliable
• Any errors in the Service will be corrected
• Google Drive Sync will remain available or that Google's APIs will remain unchanged

8. Limitation of Liability

IN NO EVENT SHALL 123 TODO, UNFORGETTABLE MANAGEMENT LTD, ITS CREATORS, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or alteration of your data
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or similar harmful components that may be transmitted through the Service
• Any errors or omissions in any content
• Loss of data stored locally in your browser or on Google Drive
• Loss of access to Google Drive Sync due to forgotten passphrase or Google account issues

9. Browser Compatibility

123 ToDo is designed to work with modern web browsers that support localStorage, IndexedDB, and service workers. We do not guarantee compatibility with all browsers or browser versions. Google Drive Sync requires browser support for the Google Identity Services OAuth flow.

10. Changes to Service

We reserve the right to modify or discontinue the Service at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

11. Changes to Terms

We reserve the right to update these Terms of Service at any time. Changes will be effective immediately upon posting to this page. Your continued use of the Service after any changes constitutes acceptance of those changes.

12. Intellectual Property

The Service and its original content, features, and functionality are owned by Unforgettable Management Ltd and are protected by international copyright, trademark, and other intellectual property laws.

13. Termination

You may stop using the Service at any time by simply closing your browser and clearing your browser's localStorage. If you are using Google Drive Sync, you may also revoke access via your Google Account settings. We may terminate or suspend access to the Service immediately, without prior notice, for any reason whatsoever.

14. Export Compliance

The Service may be subject to export laws and regulations. You agree to comply with all applicable export and re-export control laws and regulations.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

17. No Support Obligation

We are under no obligation to provide support, maintenance, updates, or bug fixes for the Service. Any support provided is at our sole discretion.

18. Third-Party Services

The Service integrates with Google Drive as an optional sync service. This integration is governed by Google's Terms of Service and Privacy Policy. We are not responsible for the practices of Google or any other third-party services linked from within the app.

19. Entire Agreement

These Terms constitute the entire agreement between you and Unforgettable Management Ltd regarding the use of the Service, superseding any prior agreements between you and 123 ToDo relating to your use of the Service.
